These Terms of Service govern your use of the arccaptaine online store and purchases made through it. In these terms, “we,” “us,” and “our” refer to arccaptaine.

By using our store or placing an order, you agree to these terms. Nothing in these terms limits rights that cannot be excluded under applicable law.

1. Eligibility and Use of Our Store

You must be legally capable of entering into a binding contract to place an order. If you are under the age of majority where you live, a parent or legal guardian must make the purchase on your behalf.

You agree to provide accurate information and use our store only for lawful purposes. You must not attempt to interfere with store security, introduce malicious software, misuse another person’s information, or conduct fraudulent transactions.

2. Products and Descriptions

We aim to provide accurate product descriptions, images, prices, and availability information.

Colors and appearance may vary slightly depending on your device’s display. This does not affect your rights if a product is defective or materially different from its description.

Product availability may change, and purchase quantities may be limited where necessary. Any material product restrictions will be disclosed before purchase.

3. Pricing and Payment

Prices and the checkout currency are displayed in our store. Applicable shipping charges and taxes calculated at checkout are shown before you submit payment. Any additional import duties or destination charges for international orders are governed by the information provided before purchase and applicable law.

Payment must be authorized before an order is fulfilled. Payments are processed through Shopify and the payment providers available at checkout.

You agree that you are authorized to use the selected payment method and that your billing information is accurate.

4. Orders and Acceptance

After placing an order, you will receive an order confirmation. This confirms receipt of your order and does not, by itself, guarantee fulfillment.

We may decline or cancel an order for a legitimate reason, including unavailable stock, suspected fraud, unsuccessful payment authorization, or a material pricing error. If this happens, we will notify you and refund any payment collected for the canceled items.

We will not charge a higher price for an existing order without your agreement.

5. Shipping and Delivery

Shipping options, charges, and estimated delivery timeframes are provided at checkout or in our Shipping Policy.

Delivery estimates are not guaranteed unless expressly stated. If a significant delay occurs, we will communicate available options and provide cancellation or refund rights where required by law.

Please provide a complete and accurate delivery address. Contact us promptly if you notice an error. Changes may not be possible after an order has shipped.

If your order is missing, damaged in transit, or not delivered within the stated timeframe, contact us so we can investigate and arrange an appropriate resolution.

6. Cancellations, Returns, and Refunds

Cancellations, returns, exchanges, and refunds are governed by our Return and Refund Policy, which forms part of these terms.

Contact contact@arccaptaine.us before returning merchandise so we can provide instructions and the correct return address.

Approved monetary refunds are issued to the original payment method. Processing and bank posting times are explained in our Return and Refund Policy.

Our policies do not limit mandatory cancellation rights or remedies for defective, damaged, or incorrectly supplied goods.

7. Customer Accounts

If you create an account, you are responsible for keeping your login credentials confidential and maintaining accurate account information.

Notify us promptly if you suspect unauthorized access. We may restrict an account where reasonably necessary to address fraud, security risks, or a material violation of these terms.

Account restrictions do not remove your rights concerning paid orders, refunds, or personal information.

8. Product Use

Use products according to the instructions, warnings, and intended purposes supplied with them.

Contact us if you need clarification before using a product. This section does not exclude our responsibility for defective products or any obligations imposed by applicable law.

9. Intellectual Property

Store content, including our branding, original text, graphics, and designs, is owned by arccaptaine or used with permission and is protected by applicable intellectual property laws.

You may browse and use this content for personal shopping purposes. Commercial reproduction or distribution requires permission from the relevant rights holder.

10. Reviews and Submissions

If you submit a review, photo, or other content, you confirm that you have the right to share it and that it does not infringe another person’s rights.

You grant us a non-exclusive, royalty-free license to display and reproduce that submission in connection with our store and products, subject to applicable privacy laws and any permissions required for promotional use.

Reviews must reflect genuine experiences. We may remove unlawful content, spam, personal information, or material unrelated to the product. We do not prohibit honest negative reviews.

Our store uses Shopify and may provide access to third-party payment services or links to external websites.

Separate terms may apply when you use those services. Please review them where relevant. Your purchase from arccaptaine remains subject to our obligations under these terms and applicable law.

Please do not send full payment card numbers, card security codes, or account passwords through email or contact forms.

13. Errors and Corrections

We may correct errors in product information, pricing, or other store content.

If an error materially affects an order you have already placed, we will contact you to explain the issue and available options. If we cannot fulfill the order on the agreed terms, you may receive a refund for the affected items.

14. Liability

To the extent permitted by law, we are not responsible for indirect losses that were not reasonably foreseeable when your purchase contract was formed.

Nothing in these terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any liability or consumer rights that cannot legally be excluded or limited.

15. Events Outside Our Reasonable Control

Events outside our reasonable control, such as severe weather, carrier disruptions, or government restrictions, may affect fulfillment.

We will take reasonable steps to reduce the impact and communicate material delays. Such events do not remove your cancellation or refund rights under applicable law.

16. Governing Law and Disputes

These terms are governed by the laws of North Carolina, United States, subject to any mandatory protections provided by the laws of your place of residence.

If you have a concern, contact us so we can try to resolve it. This does not restrict your right to pursue other lawful remedies or bring a claim in a court available to you under applicable law.

We may update these terms by posting a revised version with a new “Last updated” date.

Changes apply prospectively. The terms in effect when you place an order govern that order unless you agree otherwise or applicable law requires a change.
